Interview on SOPA and law Cinemanía Sinde

García Yago of Cinemania, interviewed me via Google Talk about the differences between the SOUP / PIPA Sinde American and Spanish law, and has published under the title " Enrique Dans: soup and 'Sinde Law' seek Internet censorship . "

Q. What are the differences that may exist between our law Sinde and the SOUP / PIPA U.S.?

A. The two are laws that permit closing pages without effective judicial protection, and both can be used to provoke censure. Differences? SOUP basically try to go a little further. SOPA measures to try to provision DNS not only block but also to force the withdrawal of advertising, and similar measures. In both cases we seek a prior restraint on the part of the sites and the creation of legislation as the managers of rights, but SOPA tries to "the long arm of the law" reaches further.

But in both cases, as it defines the problem the wrong way, not going to be useless: the problem is not the download sites, download pages are the symptom. In fact, the download sites are not necessary, just comfortable. You can download files without pages hub, just looking for what you need in a normal browser or distributed. Instead of focusing on who has better offer, trying to block the Internet, which is by nature impossible to block. The pages links are just a symptom of a bad market served by the industry.

Q. And the reaction of Wikipedia, BuzzFeed and other pages that, a priori, have no house profit or protected content?

A. It is logical. Attacking the DNS and the links is to attack the nature of the Internet and its future as a vehicle for innovation. Condition the future development of internet to the demands of the entertainment industry is an outrage, and demands this type of reactions.

What amazing is that decisions affecting the network, which is the most important vehicle for innovation and more forward looking, are conditional on what makes an industry that refuses to adapt to the times ...

Q. Interesting points so that (also in the case of Sinde Act) on the possible use of these laws as instruments of censorship. Do you see it feasible?

A. Absolutely. That's the problem: is legislation designed to rights that any broker can report without proof (and have done too often) and cause a shutdown that left defenseless to the page closed. Look at Spain: Bury can take on any form of retaliation or punishment if the complaint is false, the decision is dependent on the government body without a judge can say anything, and if you want to protest, you have to go the ordinary courts, your case will look two years after lucky. Q. Rapidshare or Megavideo?

A. They are repositories of any type of file, and respond to Requests takedown in less than two hours. It's like asking who's up to Google ... Google would punish logical because users use to find works protected by copyright? It is simply absurd
