As you can see right now, models of iPhone 2 with 3G and iPhone 4 are no longer available from the Apple Store online in Germany , although they may continue by buying physical distributors. This morning, Apple would wake up with a little scare: Motorola won a lawsuit in Germany against the company on the block to have this violation of its patents. Despite this news and as Slash Gear, the real reason for the cessation of the sale of these devices has not been said judgment, but one that Apple lost in December to Motorola for a new patent case . The number of contention is the 1010336, which is what identifies the patent that Apple has infringed, and that concerns a method for performing a countdown for mobile data transfer. This would explain why the company only has eliminated the availability of models with 3G. Even so, the next step is somewhat committed to Motorola, as will have to pay 100 million euros as a deposit if you want to continue with the process. This amount would be used to cover losses from Apple for the cessation of the sale of their products if the company did not prove to finally convicted.
However, the Cupertino consider that this amount is small, and asked the court that requested a bail of 2,000 million euros. For now, the devices involved in the case are the iPhone, iPhone 3G, iPhone 3G, iPhone 4, iPhone 3G and WiFi + WiFi + 3G iPad 2, but is expected to finish the iPhone 4S also in the list. If Motorola finally wins on appeal of Apple, the company Apple could manage to change their terminals, but is something that seems unlikely. Another possibility is that the court finally considers the request of the company trying to license its patent policy under FRAND (acronym in English just, reasonable and non discriminatory). Motorola may also grant Apple a license for its future products, but this would not be retroactive, which would not cover the current and earlier. For its part, Motorola has issued a statement saying the company is happy with the outcome and will continue fighting to defend everything about their intellectual property. What is clear is that it gets hot, since Apple has already made a public movement that reflects the concern of the company in the case.
